General terms and conditions of sale

(pursuant to Chapter I, Title 3, Part 3 of Legislative Decree 206/2005 as amended and supplemented)

1. Introduction and effectiveness of the General Conditions

The purpose of these general conditions of sale (hereinafter, "General Conditions") is to regulate the purchase of products and services, made at a distance and made available, via the Internet network, by the website shop.arteefiorifirenze.com in compliance with the Italian legislation referred to in Legislative Decree 206/2005 and subsequent amendments and additions (hereinafter, "Consumer Code").

The consumer who accesses the Site to make purchases (hereinafter "Customer") is required, before sending the order, to read carefully these General Conditions that have been made available to him on the Site and that will be available at all times by the Customer also through the link contained in the confirmation email of each order to allow him to reproduce and store them.

In the event that the person who makes purchases on the Website requires the issuance of an invoice and/or is otherwise not a "consumer or user" as defined in Article 3, paragraph 1, letter a), of the Consumer Code, the regulations on withdrawal set forth in Articles 7 and 8 of these General Conditions or, more generally, the provisions that under the same Consumer Code apply only to "consumers" will not apply. 2. Purchases on the Site

For same-day deliveries you are requested to contact us only by phone.When placing the order, the Customer agrees to provide all useful delivery information such as concierge hours, name or number listed on the intercom and a telephone number for the recipient. Should Arte e Fiori Firenze's representatives be unable to conclude the delivery due to the unavailability or unavailability of the recipient and in the absence of a concierge service, the ordered products will return to Arte e Fiori Firenze, which will immediately notify the Customer. 5.2 Invoicing of orders

If the purchase is made by a professional, it will be possible to request issuance of an invoice by checking the appropriate box during the order procedure and entering your data. 6. Transportation and delivery

We deliver from Monday to Saturday only in the province of Florence and Prato.We try to deliver all orders received by 12:00 noon on the same day unless some items are temporarily unavailable. Except for fraud or gross negligence, any right of the Customer to compensation for damages or the recognition of an indemnity is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or property, caused by the non-acceptance or fulfillment, even partial, of an order.

9. Complaints

Any complaint must be forwarded to Arte e Fiori Firenze by email to the address indicated in these Conditions.

10. Applicable law and place of jurisdiction

The sales contract between the Client and Arte e Fiori Firenze is concluded in Italy and governed by Italian Law. For the resolution of disputes relating to the interpretation, execution or termination of these General Conditions or individual purchase orders if the Customer is a consumer under the Consumer Code, the court of his town of residence or domicile if located in the Italian territory will have exclusive jurisdiction; in all other cases, the territorial jurisdiction is exclusively that of the Court of Florence, any other jurisdiction excluded.
