General terms and conditions of sale
(pursuant to Chapter I, Title 3, Part 3 of Legislative Decree 206/2005 as amended and supplemented)
1. Introduction and effectiveness of the General Conditions
The purpose of these general conditions of sale (hereinafter, "General Conditions") is to regulate the purchase of products and services, made at a distance and made available, via the Internet network, by the website shop.arteefiorifirenze.com in compliance with the Italian legislation referred to in Legislative Decree 206/2005 and subsequent amendments and additions (hereinafter, "Consumer Code").

The consumer who accesses the Site to make purchases (hereinafter "Customer") is required, before sending the order, to read carefully these General Conditions that have been made available to him on the Site and that will be available at all times by the Customer also through the link contained in the confirmation email of each order to allow him to reproduce and store them.
In the event that the person who makes purchases on the Website requires the issuance of an invoice and/or is otherwise not a "consumer or user" as defined in Article 3, paragraph 1, letter a), of the Consumer Code, the regulations on withdrawal set forth in Articles 7 and 8 of these General Conditions or, more generally, the provisions that under the same Consumer Code apply only to "consumers" will not apply. Contracts concluded with Arte e Fiori Firenze through the Website are governed by these General Conditions in compliance with Italian law. The language available to conclude the contract is Italian.
2. Purchases on the Site
The characteristics and price of the various products for sale on the Site (hereinafter "Product" or "Products") are shown on the page relating to each Product. In order to purchase the Products, the Customer must complete and send the order form in electronic format, following the instructions contained in the Site. The Customer shall add the Product to the "Shopping Cart" and, after having read the General Conditions and Privacy Policy and confirmed their acceptance, shall enter the shipping and possible billing information, select the desired payment method and confirm the order.
3. Information about the Products
Information and features relating to the Products are available in the "Shop" section on the Site. The visual representation of the Products on the Site, where available, is intended as a purely indicative image to accompany the description sheet. 4. Prices and shipping
Product prices are inclusive of all taxes and duties. Shipments have a variable cost depending on the municipality requested, always only in the province of Prato and Florence. Deliveries outside these provinces must be arranged in advance by phone or email. We schedule delivery to the first next useful day excluding Sunday. We deliver Monday through Saturday. For same-day deliveries you are requested to contact us only by phone.When placing the order, the Customer agrees to provide all useful delivery information such as concierge hours, name or number listed on the intercom and a telephone number for the recipient. Should Arte e Fiori Firenze's representatives be unable to conclude the delivery due to the unavailability or unavailability of the recipient and in the absence of a concierge service, the ordered products will return to Arte e Fiori Firenze, which will immediately notify the Customer. Nexi PaymentsOnce the order is confirmed, the Customer will be able to make payment using a card, including prepaid, or otherwise in the manner accepted by the Nexi circuit and in accordance with the relevant conditions.
5.2 Invoicing of orders
If the purchase is made by a professional, it will be possible to request issuance of an invoice by checking the appropriate box during the order procedure and entering your data. The invoice will be sent separately by our administration. The professional is responsible for the correct input of the invoicing data and is expressly informed that if the invoice is not requested during the order process, it will not be possible to request it later.
6. Transportation and delivery
We deliver from Monday to Saturday only in the province of Florence and Prato.We try to deliver all orders received by 12:00 noon on the same day unless some items are temporarily unavailable. After that time we schedule delivery to the first next useful day excluding Sunday.Product prices include all taxes and fees. All prices are in euros. Once the Products have been shipped, the Customer will receive a confirmation email. At the time of the order, the Customer agrees to provide all useful delivery information such as concierge hours, name or number listed on the intercom and a telephone number of the recipient. 7. Right of withdrawal
In accordance with Article 103 of Law 3/2015, of March, for which the consolidated text of the General Law for the Protection of Consumers and Users is amended, the performance of goods and services according to the specifications of the consumer or clearly personalized or which, by its very nature, cannot be returned or may deteriorate or expire quickly, are exempt from the right of withdrawal.
8. Errors and Limitations of Liability.
The information relating to the Products provided through the Site is constantly updated. However, it is not possible to guarantee the complete absence of errors for which, therefore, Arte e Fiori Firenze shall not be held responsible, except in case of willful misconduct or gross negligence. Arte e Fiori Firenze reserves the right to correct errors, inaccuracies or omissions even after an order has been submitted, or to change or update the information at any time without prior notice, without prejudice to the Customer's rights under these General Conditions and the Consumer Code. Except for fraud or gross negligence, any right of the Customer to compensation for damages or the recognition of an indemnity is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or property, caused by the non-acceptance or fulfillment, even partial, of an order.
9. Complaints
Any complaint must be forwarded to Arte e Fiori Firenze by email to the address indicated in these Conditions.
10. Applicable law and place of jurisdiction
The sales contract between the Client and Arte e Fiori Firenze is concluded in Italy and governed by Italian Law. For the resolution of disputes relating to the interpretation, execution or termination of these General Conditions or individual purchase orders if the Customer is a consumer under the Consumer Code, the court of his town of residence or domicile if located in the Italian territory will have exclusive jurisdiction; in all other cases, the territorial jurisdiction is exclusively that of the Court of Florence, any other jurisdiction excluded.
